These terms are an agreement between you and Certi Technologies Ltd for the use of The Balanced Instructor. By downloading or using the app, you accept them.

Who we are

What the app is

The Balanced Instructor is a planning, record-keeping and study tool for Pilates teachers and trainees. It helps you plan classes, log the hours you teach and study, keep records of your teaching, and produce invoices.

What it is not

• It is not a Pilates qualification. Using the app does not certify you to teach. Certification comes from your training provider.
• It is not accounting, tax or legal advice. Invoices and earnings figures are a record-keeping convenience. You remain responsible for your own tax affairs and for checking that anything you send a client is correct.
• It is not medical advice. Study content and exercise material are educational. You are responsible for the safety of the people you teach.
• It is not affiliated with any certifying body. We are not endorsed by or connected to any Pilates training organisation or awarding body.

Your account

An account is required to use the app. Your data is stored on your device and backed up to your account. If you sign in with Apple, you are responsible for keeping access to that Apple ID secure.

You must be at least 13 years old to use the app, and old enough to enter a contract in your country.

Subscription and payment

Prices shown in the app are in your local currency and may differ from the amounts above. The price shown at the point of purchase is the price that applies.

How billing works

• Payment is charged to your Apple ID at confirmation of purchase.
• A free trial, where offered, lasts seven days. If you do not cancel before it ends, the subscription begins and you are charged.
• Subscriptions renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period.
• Any unused portion of a free trial is forfeited if you buy a subscription during the trial.

Managing and cancelling

Your subscription is managed through Apple, not through us. To cancel, go to Settings → your name → Subscriptions on your device, or visit your account in the App Store. Deleting the app does not cancel your subscription.

Refunds

Purchases are handled by Apple, so refunds are at Apple's discretion under their terms. Request one at reportaproblem.apple.com. If you believe something has gone wrong, contact us as well and we will help where we can.

Nothing in these terms affects your statutory rights as a consumer under UK law.

Price changes

We may change subscription prices. Existing subscribers will be told in advance and, where Apple requires it, asked to consent before the new price applies. If you do not agree, you can cancel before the change takes effect.

If your subscription ends

If you cancel or your subscription lapses, paid features stop working and viewing requires an active subscription, but your records are never held hostage. You can export everything you have logged at any time, without resubscribing, from the screen you are shown. Account deletion is also available there. Those are your professional records.

Your content

Everything you enter (your plans, hours, records, notes and invoices) belongs to you. We claim no ownership of it. We store and process it only to provide the service, as described in our Privacy Policy.

You are responsible for the accuracy of what you record, and for anything you send to a client.

Our content

The app itself (its software, design, study material, exercise content and question banks) belongs to Certi Technologies Ltd or its licensors. You may use it for your own professional practice. You may not copy, redistribute, resell or republish it, or use it to build a competing product.

Acceptable use

You agree not to:

• Share your account so that others can avoid paying
• Attempt to access other users' data
• Reverse engineer or interfere with the app or our systems
• Use the app for anything unlawful

We may suspend or close accounts that breach these terms.

Availability

We aim to keep the app working and available, but we do not guarantee uninterrupted service. Features may change, and we may add or remove them over time. Much of the app works offline; syncing requires a connection.

Your data and backups

Signing in backs up your data so it survives a lost or replaced device. We take reasonable care to protect it, but we recommend keeping your own copies of anything critical to your certification or your business.

Liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for indirect or consequential loss, for loss of profit or business, or for loss of data beyond what reasonable care would have prevented. Our total liability to you in any twelve-month period is limited to the amount you paid us in that period.

The app is a tool for keeping your own records. It does not replace your own judgement, your obligations to your clients, or the requirements of your certifying body.

Ending these terms

You may stop using the app at any time and delete your account from Settings → Delete account. We may end your access if you seriously breach these terms, or if we discontinue the app, in which case we will give reasonable notice and, where appropriate, a pro-rata refund of any prepaid period.

Changes to these terms

We may update these terms. Material changes will be notified in the app or by email before they take effect. Continuing to use the app after that means you accept them.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, you may bring proceedings in your own jurisdiction.

Apple

These terms are between you and Certi Technologies Ltd, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide support for it. Apple is a third-party beneficiary of these terms and may enforce them against you.
